A Concerning Decision OSWCA Members Need to be Aware of

The Divisional Court upheld the decision of the Workplace Safety and Insurance Appeals Tribunal to provide lifetime WSIB benefits for a construction worker who, while impaired, caused a single-vehicle accident, resulting in severe and permanent injuries.
The Divisional Court has recently upheld the ruling of the Workplace Safety and Insurance Appeals Tribunal. This decision grants a construction worker, who, while impaired by alcohol and driving home after work, had a single-vehicle accident (driving off the road and rolling the vehicle), and suffered serious and permanent injuries, lifetime WSIB benefits at a criminal threshold.
