With the second phase of amendments coming into force October 1, 2019, the GTSWCA has had a guidance document prepared by WeirFoulds LLP from the perspective of both the General Contractor and Subcontractor with regards to the new Act and what changes our members can expect. These documents will help our members navigate the new Construction Act landscape, offer practical considerations and help contractors prepare for and transition to the new regime. Amendments to extend the timeline for the perfection of a preserved lien, as well as the holdback rules came into force on July 1, 2018, whereas the substantive amendments, including the prompt payment and adjudication changes, will come into force on October 1, 2019. The attached guidance documents well help our members determine which Act applies to their ongoing and upcoming contracts, as well as explain in detail the new processes, new payment timelines, consequences for missing deadlines, and possible recourse under the Act.
