Supreme Court Ruling on the Impact Assessment Act

Earlier this month, the Supreme Court of Canada deemed the "designated projects" framework within the federal Impact Assessment Act (IAA) unconstitutional.
?The Supreme Court of Canada issued its ruling on October 13, 2023, in response to the constitutional challenges presented by the Province of Alberta against the federal Impact Assessment Act (IAA). The Court's verdict established that although the federal government has the authority to establish a federal impact assessment system, the "designated projects" framework introduced by the IAA exceeds the federal government's legislative jurisdiction and is consequently deemed unconstitutional.
